These Terms of Service ("Terms") govern your use of FitChat ("the Service"), an AI-powered nutrition coaching service operated through messaging platforms. By using the Service, you agree to these Terms.
1. Service Description
FitChat is an AI nutrition coach that helps you track meals and macronutrients through messaging platforms (Telegram, and WhatsApp). The Service uses artificial intelligence to estimate nutritional content of foods and provide coaching guidance.
2. Eligibility
- You must be at least 16 years old to use the Service.
- You must have a valid account on a supported messaging platform.
- By using the Service, you confirm that you meet these requirements.
3. Account and Onboarding
- To use the Service, you must complete a brief onboarding process (consent, language selection, and name).
- You may link multiple messaging platform accounts to a single FitChat profile.
- You are responsible for all activity that occurs through your linked accounts.
4. Subscription and Payment
- The Service operates on a monthly subscription basis. New users receive a free trial period to try the Service.
- Subscriptions are billed monthly in advance and processed by Stripe.
- You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are not provided for partial billing periods, except where required by applicable law.
- We reserve the right to modify subscription pricing with reasonable notice to users.
5. Acceptable Use
You agree not to:
- Use the Service for any purpose other than personal nutrition tracking and coaching.
- Attempt to reverse-engineer, exploit, or abuse the AI system or its APIs.
- Send abusive, harmful, or illegal content through the Service.
- Use automated tools or bots to interact with the Service (beyond the messaging platform's normal interface).
- Impersonate another person or create multiple accounts to circumvent limits.
6. AI-Generated Content Disclaimer
Important: FitChat provides AI-estimated nutritional information and general wellness coaching. It is NOT a substitute for professional medical or dietary advice.
- Nutritional estimates are approximations and may not be perfectly accurate.
- The Service does not diagnose, treat, or prevent any medical condition.
- Always consult a qualified healthcare professional for medical dietary needs, allergies, or health conditions.
- You use the nutritional information and coaching at your own risk and discretion.
7. Intellectual Property
- The Service, including its design, AI prompts, branding, and code, is owned by FitChat.
- You retain ownership of the content you provide (meal descriptions, photos).
- You grant us a limited license to process your content for the purpose of providing the Service.
8. Service Availability
- We strive to keep the Service available but do not guarantee uninterrupted access.
- We may modify, suspend, or discontinue features with reasonable notice.
- We are not liable for downtime caused by messaging platform outages, third-party API issues, or force majeure events.
9. Account Termination
- You can stop using the Service at any time.
- You can request complete deletion of your data by contacting us.
- We may suspend or terminate accounts that violate these Terms, with notice where practicable.
10. Limitation of Liability
To the maximum extent permitted by law, FitChat and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid for the Service in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will notify active users of material changes through the Service. Continued use after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Slovak Republic. Any disputes shall be resolved in the courts of the Slovak Republic.
